The Photographer – the Booth Guys

The Client – The person booking the Booth Guys for their event. The contract and its terms and conditions comprise an agreement between the photographer and the client and the hire of the photo booth.

Payment – A non-refundable booking fee of £100 is required to secure the requested date by the client, the balance is to be paid in full 12 weeks prior to the event date.

Access, space and power requirements – The client will ensure that an appropriate space is to be made available for the photo booth at the venue, a minimum floor space of 3m x 3m is required. The client will provide a mains electricity supply with a suitable 13amp socket located within reasonable distance of the photo booth.

Date changes and cancellations – A request to change the agreed date of the photo booth hire must be made in writing and at least 12 weeks prior to the clients event. Any changes to the date are subject to availability of the alternative date and subject to a new booking contract. If the client cancels an agreed photo booth hire up to 12 weeks before the event date then the £100 booking fee will be forfeit. If the client cancels between 12 and 4 weeks before the event date then 50% of the total photo booth hire amount will be forfeit. If the client cancels within 4 weeks of the event date then the full amount of the photo booth hire will be forfeit.

Liability – The client assumes full responsibility for any loss of or damage to the photographers equipment (apart from fair wear and tear of props) caused by the misuse of the equipment by the clients and their guests. The photographer shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, the photographer’s liability (if any) shall be limited to rectifying such defect. Personal Accidents, any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

Copyright – Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Booth Guys in writing. The Booth Guys retain the ownership of the images we produce however we grant permission to the client to use the images however they see fit.

Website and promotional display – The client will allow the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.

Force Majeure or Act of God – The photographer will endeavour to put the clients in touch with another photographer in the event they are unable to attend on the event date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

Printing fault – If for any reason the photographic printer fails or cannot produce photos on site at the time of event, the photographer will place all photos onto an online gallery and all photos will be printed off site and sent to the client free of charge.

The Photographer reserves the right to amend these Terms and Conditions without prior notice.
